Card theft leads to charges for 3

One local man bought more than he bargained for during a trip through an Andalusia restaurant’s drive thru Sunday.

Andalusia investigator Sgt. Barney Tyree said the local resident passed through the drive thru Sunday afternoon with the intention of purchasing a meal on the go. After unintentionally leaving his card with the cashier, he ended up accruing close to $100 of additional charges when the cashier and members of her family used the card to make purchases.

“The customer paid for his food with a debit card, which is not uncommon,” Tyree said. “However, his card was not given back to him after the purchase was made.”

Tyree said the employee who completed the transaction, 21-year-old Kristy Lolley of Andalusia, later left the restaurant with the card in her possession and used the card for personal gain.

“After she got off work she used the card to put gas in her vehicle,” Tyree said. “She had made an agreement with her husband to take the card and use it for personal gain. The agreement was what allowed us to also charge her husband for the crime.”

Several small purchases led to the subsequent arrests of Lolley and her husband, 23-year-old Lewis Ray Lolley, on Monday. Kristy Lolley was charged with fraudulent use of a credit/debit card and second-degree theft of property and was held on a $20,000 bond. Lewis Lolley was also charged with second-degree theft of property for his agreement with his wife to obtain the card and he was held on a $10,000 bond.

Tyree said a third family member was charged with fraudulent use of the same card after obtaining it from the couple.

“James Robert Lolley, Lewis’s brother, admitted to using the card for his own personal gain,” Tyree said. “He actually used the individual’s card to purchase minutes for his mobile phone on two occasions.”

James Lolley was also arrested Monday and charged with two counts of fraudulent use of a credit/debit card. He was placed in the Covington County Jail under a $20,000 bond.

Andalusia Police Chief Wilbur Williams said the arrest was expedited by the victim’s diligence in checking for foreign account activity.

“The individual, upon realizing his card was missing, logged onto his account online to check for purchases made,” Williams said. “He identified the presence of purchases made after his card was lost and we were able to use the information to locate the establishment where the theft occurred.”

Only in Andalusia is an ID not needed when you use an ATM/Credit card!

I ALWAYS make sure my card is placed back in my wallet prior to exiting a store, why didn't he? I dunno....just an overlook I guess, but I'm glad they were caught for this act....it's so sad that people have to steal from folks these days...

Don't give Andalusia a bad rap. I use my card all over south Alabama and the panhandle of Flordia and have never been ask for ID.

Yes your right bowling fan I went shopping on Monday to P-cola and used my debit card several times and got Id ones at Aeropostale and I thanked her but I wish more and more people would ask for Id

You may disagree with me,but I feel that you should have to show an ID. This is for your protection, not the store. If you have ever had your id stolen, then you will know what I am talking about!!
I would rather take a extra few minutes to show an id than 6 months to clear up the bad credit in my name!!

Very often I give my card to one of my kids to pick things up for me while they are at walmart or the grocery store when i dont feel like going, and to my young daughter when she goes shopping..that would cause alot of stores to lose business and alot of people like me alot of trouble.

Instead of signing your name on the back of your card as sugessted put "check ID" that way the store will ask for your ID, plus if it is ever stolen the thief wont have your signature to duplicate. Just a thought. Try this it may work.

I agree with some of you.....it is convenient to send your card with your children when you don't feel like going to the store. I've done that same thing. As far as ID being asked for, that's a good idea, but it's also a bit aggravating for someone in a hurry to have to rustle through their purse and stuff. Personally, when I use my card, I never let it leave my hand. The cashier at the store where I purchase things or use my card never touches my card, so there's no chance of me leaving it or forgetting it. Most all business now have the swipe it machines so you don't have to hand your card over.....Maybe it's just me, but folks should be more careful with their cards and there would be less theft of them.

if all of you want to know a real kicker, the people that stole it , used it at a gas pump and didnt have to enter the store. but i recommend that know one does this because your entire life will be messed up.
