Phillips gets 3 years

Should be out on appeal bond by lunch

Montgomery County Circuit Judge Charles Price issued a 10-year split sentence against former Probate Judge Sherrie Phillips, ordering her to serve three years of that sentence, but her attorney expects her to be out on an appeals bond by early afternoon.

Phillips was found guilty in October of first-degree theft by deception, by knowingly obtaining unauthorized control of a check for $1.8 million or any proceeds of the check, which was the property of the estate of Cary Douglas Piper and/or the State of Alabama; and as a public official — the probate judge of Covington County — intentionally using her official position for unlawful personal gain for herself or a family member, of a check for $1.8 million or any proceeds of the check.

Judge Price sentenced Phillips to 10 years on each of the counts, with a three-year split sentence, to be served concurrently. He set her appeal bond at $20,000 in each count.

Price also ordered Phillips to pay $5,000 in victims' compensation and to repay the $917 difference in the amounts taken from the $1.8 million account and the amount repaid when investigators started asking questions about the estate.

Before issuing his sentence, Judge Price, who said he taught Phillips when she was a student at Jones Law School, said, "The problem that happened in this case was greed. Greed can overtake the strongest of individuals."

He said he wasn't interested in sentencing Phillips to the penitentiary "thinking I'm doing something great for the reduction of crime."

However, he said, he firmly believes that public officials "should be held to a higher standard."

Phillips left the standing-room-only courtroom in the custody of Sheriff Dennis Meeks. Her attorney, Riley Powell, said that she would be released pending her appeal once her family posted the appeal bond, which he expected to be completed by early afternoon. Her attorneys have approximately 30 days to file that appeal, which could take 18 months to two years, he said.

She should have to go away PERIOD! Oh well, this is a lesson well taught. If you know enough folks in high positions, do what you want....you CAN and WILL get away with it.....uhmmmm...anyone notice that Judge Price just now admitted to being her instructor in law school? I didn't see this anywhere before?? Did I miss it...? It's possible, but I just don't remember seeing that little tidbit.

Well, I think she should have been subjected to a higher standard of punishment. After all, she was a judge with a law degree and she KNEW she was doing wrong. 3 years??? Is that all??? I realize that she has never been CAUGHT before and has nothing on her record, but she should have had a harsher punishment because she does have a law degee.

I also feel that a mistrial should be declared and the case should be retried. If the judge taught her in law school then he is affiliated with her. That means that he could have given her special consideration. We need an unbiased judge to come in. I bet she would get more than three years then. What do you think????

ABSOLUTELY! That's what I was thinking thevoice, that a mistrial should be granted, and that she should be RETRIED by a Judge WHO DOESN'T KNOW HER OR WHO HASN'T BEEN AFFILIATED WITH/BY HER! There is NO JUSTICE in this County.......we all should have known that she had yet one last trick to pull out of her hat, or at least the Judge did.

She'll NOT serve ONE stinkin day for this. She may have well not even been caught except for the fact that we can hope that she doesn't get herself back into any office,public or private, where she can manipulate the system to her advantage again.

Justice was NOT done here. I'm calling the AG myself....

this is joke to everyone in covington county. as the old saying goes "it is who you are". anyone else and they would be in the penitentiary. everyone involved is this should be ashamed of themselves. why is it that the judges in covington county excused themselves and then they got a judge that taught her in law school. what was the sense in this!!!!!!! maybe i should rob a bank and pay most of it back tomorrow and see what happens!!!!!!!!!

I have lost all hope in the judicial system in this case. I have never in my life seen such politics in a court case!!! She needs to be strung up from her toenails in the highest tree. Also, the judge has proven that he is crooked also because he knew her and taught her and didn't open his mouth. Why did the newspaper not report this fact until now either??? I give up!!!!!!

This is rediculous! How can a judge who knew the defendant sentence or hear the case. This is worse than having a jury that was perjudiced. Mistrial! Plus sanctions on the judge or fines at lease. If this was heard in another state or the crime committed in another state. She would serve much more.

Judge Price is correct. His sentence of Sherrie Phillips did nothing for crime reduction. To the contrary, the sentence demonstrates that elected officials have little to fear for abusing their public offices. Ms. Phillips’ sentence is so minimal as to be meaningless as a deterrent to other politicians tempted by power and greed. I predict that Ms. Phillips will use lawyer tricks and political influence to avoid spending a single night behind bars. Shame on us for electing such people.

Sherrie Phillips is a good person that was found guilty of a crime. It was a mistake and everyone makes mistakes and no one is perfect. You just learn from them and go on living life. If it was you or one of your family members no one would think twice about it. It's all because she is a political figure. It's a waste of time to say what she does or doesn't deserve if you don't even know her and all you do know is what you've read or seen on tv. It's over now so give it up. Talking about it isn't gonna make any difference at all

Uhmmmm.....southernsweetie....you need to take a lesson in criminal prosecution....obviously you've never had you or any of your family, taken by the likes of Sherrie Phillips...."she a good person"....righty, as long as she's stealing from dead people's estates and the rightful heirs....that makes her good in your eyes....I think you're in the wrong forum here. It's not just that Mrs. Philips is a politial figure. The fact is that she has probably had her hand in all of our money at some point in time as Probate Judge. Not that she has always made those dishonest decisions with the money, but we will probably never know now. She wronged not just the Piper family but every person in our county. I completely forgive her bad judgement, however I do think that had she been less of a public fgure then the punishment would have been stiffer.

Like the judge said....GREED can overtake even the STRONGEST of individuals. Lets just ALL pray for Phillips and HELP her on the road to a recovery!

And people, if our system is FAIR and treats Phillips like ALL other criminals that go through the doors, then she should receive probation for a first time crime. That is what most all first time offenders get. I am not saying that that is what 'should' happen but that is the way it goes. All should be given an opportunity to clean themselves up, turn themselves around, and given a fresh start!

We all have to work together to prevent things like this from happening....and to help the ones who have done it to realize their mistakes and change. THAT PEOPLE, IS TRUE COMPASSIONATE CHRISTIAN CHARACTER!! Think about that...especially the ones who claim christianity! Don't make the lord frown on you. Make him smile and say "good and well done faithful christian!"

....And why would you want to show your behind and make a fool of yourself in public 'trying' to more humiliate her?? Beats me....That is poor character...Our town needs to rid ourselves of all the poor character and be a better place to be. I can just imagine what an outsider looking in would think of us if they read these postings of everyones 'stories'....just a shame, thats all.

You know there is a story about 2 men praying. A tax collector and a pharosee (sp?) The pharosee prayed that he thanked the lord he was not like all these people, including the tax collector, he thanked God that he was 'this and that' and that he paid his 'this and that' etc... The tax collector just prayed to God that he was a sinner and for God to please have mercy on him.
The story goes that the lord said the tax collector went home justified and the pharosee did not!! THINK ABOUT THAT PEOPLE!! Just some food for thought....

I have been waiting for this since she was found guilty. I knew this would happen and it did. I agree with patwilliam... call ag! I intend to. This is a disgrace to Covington County. How can you be a good person and steal money that was not yours? How many more families have been victims of her greed? How many times did she spend someone else's money and never batted a eye. SHE knew what she was doing. That is not only bad judgement but lack of morals. How could anyone defend what she has done. If it was your family she took advantage of, how would you feel? It doesn't matter what anyone else would get as a sentence. SHE IS AN ELECTED OFFICIAL AND SHOULD BE HELD TO A HIGHER STANDARD. I think that is what is angering everyone. She's not some first time offender who just had a momentary lapse in judgment. She was responsible for large (and small) sums of money on a daily basis for years, and knew good and well what she was doing. It was pre-meditated and well thought out. I also feel that if she had shown one little smidgen of remorse throughout this whole thing the citizens may have been a bit more compassionate. Yes, she should get Christian forgiveness, but forgiveness doesn't mean that she shouldn't be punished for her crime. Oh, and when the person who taught her Sunday school class testified today I wanted to ask him if she was absent the day the 10 Commandments were covered? She must've been, because thou hast stolen!!

I too know Sherrie and I feel extremely betrayed. The people who are elected by the people to serve the people should face a higher standard than you and I. If I robbed Wachovia today but before the police came to arrest me I drove threw the drive-thru and gave the money back do you think they would tell me great job, we forgive you, now go home to your family. No way, they'd snatch me up, handcuff me and do the media walk so folks would know they had caught the bad guy. Like it or not some of our elected officials are "the bad guy". I think Phillips downfall began with the termination of Patricia Gunter. You don't trample on and turn your back on the people who got you where you are. We all have skeletons in our closets and not one of us reading or writing here is without sin. I have not read one comment where anyone thinks they are sin free, I have just read comments from frustrated Americans who are tired of being lied to and deceived by those we elect to lead us. I feel that public officials should face a higher standard than those of us who work a forty hour week at McDonalds. Right is right, wrong is wrong. It is not our place to judge, on that point I agree but we didn't judge, a jury of her peers did and they have spoken. I think her law school professor should also face sanctions because before he was appointed to hear the case he was asked if he had any afficiation with Phillips. Appears to me that he was dishonest and broke the law also so he needs to be sitting in the cell next to hers. Meanwhile, continue to pray for our country, state, county and cities....we need it. I encourage everyone to continue to be involved and let your opinions be known, these folks are paid by our tax dollars and should answer to us.

Well said scoop....it is such a shame that the people that we, as the people of this county, elect these folks, and when they do WRONG, it's okay by the system, cause they are "outstanding, church going citizens". Not downing the Christians or churchgoers in any way, but Sherrie clearly must have been absent on the day the Ten Commandments were discussed....that's obvious. It's just so sad that our elected officials can do whatever they want, and when they are caught by a luck of the draw, they aren't punished in the same way as you and I would be.

What makes Sherrie special. She's a lawyer. She's a judge. She's worked with the system for 30 some odd years. So????? This doesn't give her a free ticket to steal from everyone, as she has no doubt done throughout her tenancy as such.

Why did her Judge Price not admit initially that he knew her on a personal level (and was this just a slip of the tongue today), that he was a biased judge for this case. There are a multitude of judges that I'm sure could have done a more fair job that this, and not brag to us cause he taught her classes in law school.

I think a mistrial is in line here, and if one is not granted, then the next time some of your friends, family, acquaintenances are arrested for theft (God forbid)...make sure they get Judge Price to hear their case, cause he's obviously not prejudiced in the least (right).

Whatever the case comes to be, I urge each and every one of you to call the Attorney General, and make sure your voice is heard on this, cause it's WRONG, WRONG, WRONG! And whether she will be or not, SHE SHOULD BE DISBARRED and not allowed to practice law or be involved in the legal system AT ALL! Lawyer, Judge, counselor...etc. She should be stripped of all of her qualifications (if she has any) and put out to pasture with the rest of us who have to work and earn an honest living. She should have to earn her wages instead of having them given to her or giving her the right to steal them.....that's all folks.

I am glad trishamcvay loves Sherrie and is glad she is at home with her family. My first point is that Sherrie Phillips chose to live a public life and be subject to public opinion when she ran for and was elected Probate Judge of Covington County. Had she not made the decision to run for public office she could be living a normal life free from the spotlight. She chose her life and she chose to steal from dead people and now she must chose to stand up and be accountable to the citizens for her actions. Nobody put a gun to her head and made her seek a public office, she decided to do that because she liked the attention, the perks and oh yeah, the paychecks. She sure didn't mind cashing those checks did she? She sure didn't mind it then. My second point is that nobody here has said they hate Sherrie Phillips. I'm sure they, just like I do, love her in Christian love and pray for her just like we pray for everyone. I don't get where you can judge all of us and say we are haters when you don't know any of us. Her family, in my opinion, must assume some responsibility in this as well because each of them profited from the money she "borrowed". I'm all for this family going on with their lives and if that is truly what Sherrie wants then she should accept her punishment with the same grit she dealt punishment down to others and not appeal because if she appeals it will be her, not us, that keeps this thing in the public eye. Every person locked up in the county jail or state pen has family and friends, just like Sherrie does and I know they want to be home with their families too but they don't have the influence and resources Sherrie does so they must sit behind bars and serve the sentence imposed on them. I don't hate Sherrie Phillips, in some ways I feel sorry for her because I still don't think she sees where she did anything wrong and that is what is so sad. I pray when she finds herself alone in a cell at night that she takes time to reflect on her actions and realizes the damage she has done. What makes our country so great is that once she serves her time she will have the opportunity to rebuild her life and she will receive a second chance at life. I wonder if all the people who have been victimized by her through the years will have that same opportunity? Probably not.

I am amazed that there are people who are still supporting this woman. However, I will say that it does not matter what we say or how we feel. We are not the ones to judge Mrs. Phillips. She will receive her judgement one day and justice will be served. Let's not waste our time being angry at the system, but be grateful that we can rest peacefully at night knowing that we did our best to live that day treating others as we would like to be treated. I will pray for Mrs. Phillips and hope that she can be forgiven, for if not I tremble at what she might face.

To southernsweetie_79: Mrs. Phillips isn't a good person anymore-she is a convicted criminal and unless she can pull off a reversal of her conviction for the rest of her life she will be a convicted criminal.
Now for all you folks that think she should get probation because it's her first offense---get real. You don't start out stealing $1.8 million, you practice on a few smaller ones first. No telling how many people were robbed before this one and those folks didn't have the money to hire an attorney and go after her. I bet we find out this isn't her first offense--it's just the first one she got caught at.

Amen, patwilliam!!! Preach on!!! The problem is that amazed doesn't agree with what you are saying, so amazed feels that he/she needs to condemn you for your opinion. The first amendment protects our rights. We have the right to our own opinions. Amazed does not have to agree with everyone's opinions because they are just that - OPINIONS. Opinions are like belly buttons - everyone has one. Just because you don't agree with someone else's opinion does not make either of you wrong or right. It is simply your point of view. Yes, Sherrie did wrong. Yes, she should pay for her mistakes. Those statements do not mean that anyone hates Sherrie. I would make those same statements for any criminal. If you do the crime (regardless of who you are) you should do the time. If you rob a bank, then you should be punished. I guess that statement makes me a hater on bank robbers also, huh? Let's all keep this in perspective and respect each other and the feelings and opinions of each other. This is nothing to start a war over.

I think some of these posts are either from Sherrie herself or her family members. I see how they could be so angry, but not just an outsider looking in would really post some of this stuff. You just never know who watching, listening and posting. Keep on bring the views people. That's what it's for.

I agree with cookie. She does need to be prayed for, but I can also sympathize with everyone else. We all feel like she betrayed the trust of the people of Covington County. This betrayal makes people mad. The worst part is that she is still smiling and she has shown no remorse. Personally, I could take all of this a little better if she would at least quit smiling and show that she is sorry. I hope that one day she will be truly sorry and repent and that the Lord will have mercy on her soul.

The justice system is a whole different world in Covington County. I knew all she would get was a slap on the wrist. You have lawyers that were convicted of stealing that are still practicing law in Covington County. Hell I won't be surprised if she gets her job back.
But I will tell you this if it were a regular person they would have put them under the jail.

If one of my family members did this, I would not defend them! I would pray for them and hope they repent to God but I still think they should have to pay for crime, family or not! Yes, as Christians we are to forgive and pray for that person and love her in a CHRISTIAN WAY! She is still a convicted criminal just like any other criminal in the system. One sin is just as bad as another. You still must pay for what you did. That is what most everyone on here is trying to point out, some people just don't want to accept that she is a CONVICTED CRIMINAL!!!!

One last post here folks...thanks for the support, and yes, I do agree that the retaliation of amazed must have been someone close to Sherrie. I don't feel that I said anything that any of us weren't thinking. I'm not hiding behind anything, my name is in plain view, but that's beside the point. I do have an opinion, I WILL VOICE IT, and it will be heard, so if you don't like it amazed, don't read it. I'm not an innocent person, nor are you, everyone makes mistakes, and MOST people must pay for them.

I never stole 1.8 million dollars from anyone, but because Sherrie did it in her position as probate judge, does NOT make it right, and she should have to pay for her crime.

Gossip feeds into our natural desires to feel superior to others and to belong or fit in, so combating it in our personal lives cna be a challenge. But if we choose to love through prayer, our lives can be a gossip free zone.

Lord forgive us for speaking carelessly about others to make ourselves look better Help us to think before we speak. Teach us to be loving with our words. Amen
You can never justify gossip.

Sherrie, guilty or not only you and God knows. what it is your heart. and i will always be praying for you not judging because I know one day I will face our God and he will judge us accordingly you and your family are in our prayers

Amazing how poeple want "ultimate justice" when it is not us and how we want "ultimate mercy" when it is us or a family member. You are required to obey the laws of man while on earth and must suffer the consequences for not doing so. Let us not forget that one is guilty of theft if you take a pen home from work. We should all be thankful there is a way to reconcile our indiscretions in the other than worldly realm.

Littlejohnny...Stealing $1.8 million from a dead person is a little different than taking a pen home from work. I understand the basis of your statement, but let's get real. No one has been defrauded if I take a pen from the bank or home from work...poor Mr. Piper's family and estate were defrauded when Sherrie "borrowed" that money in order to buy herself and her family members new vehicles. Who knows how many other families she has "borrowed" from who don't even know it yet. Yes, I understand that sometimes people want mercy for their families when they are caught in sticky situations, but I, for one, would not defend my family member in a situation like this by saying, "oh sorry, no big deal." I think that is what everyone is so outraged about...no one in Sherrie's family, including Sherrie herself, has shown any remorse for "borrowing" the poor dead guy's money. I think if the family and Sherrie came out and publicly apologized, not smiling, but crying, some people would be able to forgive her. I don't know...this is just my feelings on the situation.

Oh my gosh!
I dont feel sorry for her family, not at all. Seems it didnt affect Bud not at all to drive around in that new truck she bought him with all of that money did it? Oh yes it really bothered her to go and buy herself that new Escalade? oh yes this sounds like a church going woman to me!

Cant say that I would attend that church though! Yes she has the right to be forgiven by God, only if she ask, and she means it!! Just because you attend church does not mean you are a christian!! she had no remorse for what she did, she actually thought she would get by with this with out someone finding out what she did!! She actually in her own mind thought she was above and beyond the law, well guess what Sherri, YOU GOT CAUGHT SISTER!!

This "she is only human" bull is getting old. When you take an oath and are sworn into an office, you put yourself up on a higher position than us "commoners" , those words that were read to you when you were sworn in werent just words to be read, it was an oath you agreed to!!

Now stand there and take what is given to you like a woman, and stop trying to hide behind all of the lame excuses!

O.K. I guess I need to jump in here and say that it has already been said that I don't hate Sherrie and I only want to see justice and it don't seem to be happening. Pat you and the rest keep on. I can't remember how to get in here sometime. If anyone would like to help me I would be grateful.You know I think that all the transfusions I have had has came from forgettful people will someone please email me and tell me how to get in here.LOL. One Last thing. I honestly with all my heart don't hate Sherrie and I just feel that she is no better than anyone else to have to pay the price. Ya'll are right there are people in jail and prison that are repeat offenders but tell me this HOW MANY STOLE 1.8 MILLION AND WENT ON A SHOPPING BING

I have known Sherrie since she was 16 years old. ( I was her boyfriend then) I haven't seen her since 1967 but knew she would one day become a lawyer or such and make something of herself. So did I. I served in Vietnam as a gunship pilot, became a commercial pilot and now I own a million dollar business in Atlanta. I did this with an eight grade education. My point is..everyone is human and occasionally does stupid things they will later regret. God did not make perfect people. If any of you are perfect or think you are just look in the mirror and say "by the grace of God there goes I" She screwed up, maybe out of desperation or whatever and should be repremanded as I did men under me. The Judge should have stepped down due to conflict of interest by knowing her all those years and called for another judge. But it is still considered a first affender case and she should be shown some leniency
in the fact that she has achieved what she has in her life and it was a one time screw up. Sure, she should pay her dues set forth by the courts but it is not up to the public to judge or ridicule her. IT COULD BE YOU! And never say it won't be. She has enough to deal with now and it's called "shame" she doesn't need the people she used to call friends turn their backs on her because she screwed up. We are all human. Let's act like it!!!

The question is not whether Sherrie is good or bad, but did she help her self to Mr Piper's money.

YES, SHE DID.

I GUESS IT IS O.K., BUT YOU HAVE TO BE A GOOD PERSON TO MAKE IT NOT A CRIME.
SO THOSE WHO STEAL FROM OTHERS ARE GOOD PEOPLE

It is ironic that some people try to pursuade others into believing  former Jugde Sherrie Phillips made a mistake and all the while make excuses for Phillips actions against a dead man.  Whom cannot speak out against his unjustice. YOU HAVE TO REMEMBER SHERRIE IS A GOOD PERSON. Lets not  mock Sherrie's intellect or ours. She is a thief and  got caught with her hand in a dead mans pocket. Actually, she thought she could pull  the wool over the eyes of honesty and justice. Over the eyes of people who know stealings wrong. If she had not thought this, she would never have taken Piper's money in the first place. No Sherrie is not a good person. What can redeem her from this crime. How bout jail time.  Come on people get you head out of the clouds. Phillips stole his money and distributed it among family, friends and foe. Do you honestly think she was going to return the money own her own.  If that was the case, she would have never gave monetary gifts to certain individuals. Does Phillips think people are so unaware of the fact that she manipulated Piper's estate to benifit herself and others.  It's apparent  Phillips has double standards.  She must have two sets of law books,  one set of  laws that apply  only to her and another set of laws that governs  the general population, which plainly states when you take something that is not rightfully your you are stealing and according to law stealing from other is a punishable crime.
