City adjusts noise rules
Published Wednesday, March 4, 2009
A proposed noise ordinance for the City of Andalusia has been revised with a focus on reducing noises from vehicles.
Mayor Earl Johnson said the previously proposed ordinance was very detailed and would have been difficult to enforce.
“What we’ve tried to do is to identify the major problem areas in the city and deal with the noise that creates nuisances,” Johnson said.
The revised ordinance, for which the council had the first reading last night, makes it unlawful:
• To use compression release engine brakes, also known as “Jake Brakes.”
• To discharge into the open air the exhaust of any internal combustion engine of any motor vehicle except through a muffler in good working order and in constant operation. The sound therefrom shall not be such that it is audible outside a radius of 50 feet of the vehicle.
• To operate sound amplification systems in any motor vehicle which is plainly audible outside a radius of 25 feet.
If approved at the council’s next meeting, set for March 24, the ordinance would require that first offenders receive a warning, and that violators be fined not less than $50 and not more than $500 or up to six months in jail for subsequent offenses.

Thank goodness for the Jake Brake addition to this ordinance. They are abused and overused by many truck drivers. Thank you city council for including this in the ordinance.

Well, 25 feet is ridiculous because if you just have a radio and if you're like me and like to ride with the windows down instead of the a/c on you're gone hear the radio even though it's just a radio and not even a soundsystem.

What is it with these people that ride around with the radio blasting. I was at a redlight the other day, and this idiot pulls up beside me with a very loud radio. I wish he knew how stupid he looks. I mean come on,if you can't here the radio go buy a whisper 2000 hearing aid.

Do something about these kids that "roll" thru wal mart parking lot with the music so loud that it rattles their own car! They think that are showing off when in the long run we are just laughing at those idiots!!
And these wanna be street racers "trying" to make their cars like the ones in the movie "fast & Furious", with an oversized exaust systems that when they crank the vehicle up, and oh my God!! Do something about that please!!

Looks like Harley Davidson motorcycles will be banned from within the city limits from now on.

Earl must have been abused by an 18 wheeler when he was a little boy!! First time around He banned drivers from taking their rigs home. Now nothing wrong with prohibiting a loaded or 18 wheeler from navigating the neighborhood streets - but a driver is not allowed to drop his trailer and take the "bob tail" home. These things are less wear a tear on the streets than Earl's country club buddies and their mammoth motor homes. And little consideration was given to informing a visiting driver of the "no rigs allowed in town" - ever noticed where the "Not Allowed" signs are posted? They are after a trucker has made the final turn into town - too late then, can't back up without breaking the law, so he's stuck.
Now Earl is after the Jake brake. Not unusual for cities to prohibit the use of Jake brakes and signs are posted to let the driver know. Many over the road rigs are required to use Jake brakes and may come traveling through not knowing to turn them off while coming through Andalusia.

It's so nice to see some of you were never young and carefree. Kids grow up. Let's make the strictest rules we can and run these young folks to other places to make their living. Certainly would not want them to grow up and be productive adults in Andalusia, would we? It seems the politicians in Andalusia would rather run locals out and bring strangers in.
Bamadan, you can bet they will be banned as any other vehicle that doesn't meet the "code". Hope our pick-up can pass their ears. If not, our money goes to Opp.
Ouiet, children, fuddy duddies are out!

Correct me if i'am wrong, But doesn't a jake brake help slow down or stop an 18 wheeler????? Sounds like the mayor wants to find more work for his police department since they do not go outside there city limits anymore to answer calls. MAY BE more wrecks with 18 wheelers if this happens. But lets hope not.

star - yes the Jake brake does aid in slowing a loaded 18 wheeler or one in hills and steap declines. It isn't necesary around here unless the load is real heavy. But some "hot shots" like to use them to hear the roar from the back pressure

Id rather them use their "jake brake" ANYTIME! I really dont want the grill of a 18 wheeler sitting in my backseat.

Too bad they can't do anything about the noise that comes out of people's mouths!! It's more annoying than loud music, cigarette smoke and jake brakes put together!

Amen to that, Southern Attitude, I myself have 2 pickups with dual exaust, they aren't overly load but they do get noticed. I don't run through town revving up my engine but they definately aid in peoples awareness of other traffic on the roads, as well as reduce deer on the road at night. I too am willing to take my business elsewhere if this ordinance goes into effect. Sorry Andalusia, but I work too hard for my money to be harassed while trying to spend it.

"Hope our pick-up can pass their ears. If not,our money goes to Opp." Hahah thats funny! Uh what are you going to buy in Opp? Maybe some groceries, but thats it.

There are alot of good kids in this town and if the worst they do is turn their radio up too loud I would not consider that a problem. I have teenagers and I will be the first to say they are not perfect but they do not steal, do drugs or hang with gangs. If they play their music too loud you will not hear any complaints from me. That is not even an issue when you think of what they could be doing. Lets stop picking apart everything these kids do and concentrate on things that really matter.

lookeyhere, you are exactly right and that is what I am talking about buying... groceries! Opp has a better selection than Wal-Mart has manged to restrict their competitors to in Andalusia. The selection at our local stores went downhill ever since Wally World opened their supercenter. There are no choices in products anymore.
The people in Opp are much friendlier, too. So there you have it. Monthly trips to Pensacola have great results for shopping, as well. The internet even has deals that can't be beat. I prefer not to spend my money in Andalusia to support a city that does not support it's citizens. I avoid Andalalusia like the plague anyway.

This topic is getting old, no one can be totally pleased all of the time, there are a few persons in Andalusia that run the show, what they deem wrong is sooner or later wrong. They get laws passed or ordinances put in place because they feel other persons should not do, what they say is annoying to them. I think if you took a vote, most people have no problem with anyone riding around with music blasting. They are U.S. citizens and should have the freedom of choice, wether they play it loud or not. I can see a law that stops this behavior during sleep time hours, but not any other time. If we look hard enough, we will all find annoying things about each other. 50 feet is stupid, I can fart and you will hear it 100 feet away, within 50 feet is the kill zone (stink)...lol....but seriously, can't we find more productive means, we are making an ordinance that makes it against the law to use a product or products, that we can legally purchase at several local stores. If it is going to be illegal to play loud music, then make it illegal to sell the items such as amps, that are required for loud music, in any businesses in the city limits. Why tempt the kids, that makes it simple, this ordinance punishes the consumer but does nothing to the person that sells the stuff. It is time to be more constructive with our councils time.

For the ones so worried about harming your ears with loud music, the old folks home has a room waiting on you. Unless your 90 years old STOP acting like it!!.You will be there soon enough without pushing it!!...... This is America, Andalusia dont belong to anyone------- everyone pays taxes and should be able to live as long as they are not hurting anyone, as they see fit, They have a right to play their music, music calms the beast!:)..Like tankmaster said, we could pick apart everyone in this town for things that each person may see as annoying, what if we all really did that? What kind of place would we all live in. The list would be a mile long.

Okay here we go,it is very simnple,it don't take a brain surgeon. Most people could care less about your music. I mean come on,we do not won't to hear it. I really don't care if a young person drinks a beer. The beer I can't here. Oh yeah, they can't go to the woods. The big bad wolf is waiting on them,oh no thats right, its the ABC,WHAT A BUNCH OF LOOSERS.

I have respect for law enforcement, but the ABC should be dismantled. Who thinks the same? Its a waste of tax payers money.

The noise ordinance will quiet it down on Friday nights during football season. No cheering, no band. The band is so loud you can hear it outside the city limits. That also means there will be no parades. The marching bands are loud as they stroll down the street. Political rallies on the square will have to stop. Too loud. I guess they can be no more garbage pick up, either. Those trucks are loud, too. While we're at it let's take all of the back up beepers off the city equipment, they too are loud. And God forbid some little girl squeal too loud on the playground because she is being tickled. Oh yeah, the noise ordinace makes a lot of sense.

"Lookeyhere",
You obviously don't get out much, besides the fact that it doesn't have to be a trip to the grocery store, it also doesn't have to be Opp. There are far more products purchased in Andy than simply groceries. What about auto parts, restaurants, hardware store, gas? Think about the gas alone, the first $60 tank of gas I buy in Andalusia that costs me upwards of $560 after the noise ordinance ticket (because someone whines that my exhaust hurt their "wittle ears") will without a doubt be my last. I live on the outskirts of town and can afford to boycott Andalusia, Crestview is nearly as close as any other sizable city anyway, with much more selection. I currently spend hundreds/sometimes thousands a month renovating my home, I'd have no problem driving to Lowes if the city doesn't want my business. Sorry Breedloves/Cash-n-carry… take it up with the Mayor.
