Phillips transferred
Published Friday, October 30, 2009
Former Probate Judge Sherrie Phillips was sent to the Julia Tutwiler Prison for Women on Thursday, exactly one year after a Covington County jury found her guilty of stealing $1.8 million from a probate estate.
Covington County Jail Administrator Capt. Preston Hughes said Phillips left the jail shortly after 8 a.m. She was one of two people “sent up” to state Department of Corrections facilities. She had stayed in the county jail less than a week before her transfer.
Phillips was convicted Oct. 29, 2008, of first-degree theft by deception, by knowingly obtaining unauthorized control of a check for $1.8 million or any proceeds of the check, which was the property of the estate of Cary Douglas Piper and/or the State of Alabama; and, as a public official, intentionally using her official position for unlawful personal gain for herself or a family member.
She was sentenced to three years in prison, followed by three years of supervised probation.

It will be interesting to see how this plays out. If Phillips is given special treatment, will anyone in a position of authority stand up and call foul? I know this question has been asked previously; Why has the District Attorney in Covington County not investigated other allegations concerning Phillips' abuse of authority while in her position as Probate Judge? Keep this question in mind and ask it again when we get up close and personal to candidates in the next election.

LoyalAmerican : first of all, Good morning and welcome back. I hope someone has a way of tracking her activities while she is away. I'll almost bet you that she already has an office job set up at the prison and if she does, everyone involved in not investigating her further and helping get her special treatment needs to serve real prison time too. Politics and the good ole boy system just makes me sick.

Three years for stealing 1.8 million dollars? If there exist no double standard then why are young men and women getting 5 to 10 years in the courts of Alabama for a small amount of marijauna or a loritab pill outside of a pill bottle. Evidently there is a second set of rules( laws) for the elite in society.
The mayor of Birmingham ,Alabama from what I am reading is looking at 800 years in prison. It sure looks like we are living in a lawless society when some get a "slap on the wrist " and some are crucified. It sure makes you wonder. The "New World Order" rules the day.

Loyal American, good question about the lack of evidence that our District Attorney has investigated any other cases whereby Phillips stole from the taxpayers. If she has stashed away more millions, then the short three year sentence will provide quite a payroll during that time. Also, how has she "repaid" all the funds and keep everything she had bought still ride her Cadillac and keep her lifestyle. She has more stolen money stashed away for her family to live on while she is in jail. This still stinks.

Are you kidding? The new probate judge says there is not a record of my parents guardianship or rules of guardianship on file. Do I believe that? Duh! He will not enforce them either. So go figure. She will be out in less than a year.

How was she "Sent Up"??? Did she go by Correctional Van and was she in handcuffs or did she travel in STYLE with no restrictions??? I, like many others wonder why our LOCAL LAW ENFORCEMENT OFFICERS failed to investigate her other illegal acts!!!

Here is the lyrics for Lonesome Jailhouse Blues.
Standin' in the jailhouse
A-wishin' I was free
I'd like to get out
But I ain't got a key-ey
I got them lonesome jailhouse blues
A-waitin' for a train that'll take me away
And I'll be gone for many a day
I got them lonesome jailhouse blues
A-standin' in the jailhouse lookin' at the street
And this jail floor is hurtin' my feet
I got them lonesome jailhouse blues
A-watchin' my friends as they go by
They'd get me out if-a they would try
I got them lonesome jailhouse blues
A-lookin' down that lonsome railroad line
I'm thinkin' of a life that I left behind
I got them lonesome jailhouse blues
The jury said that I have to go
When they sit me here without a show
I got them lonesome jailhouse blues
So goodbye friends I'm a-leavin' today
The foreman train's gonna take me away
I got them lonesome jailhouse blues
The governor's spare don't worry me
It's the way I feel that makes me sing
I got them lonesome jailhouse blue-ues

average_joe, some of the original stories in the paper explained how she paid back the money used from the account. It was explained that her brother, who is apparently a successful and wealthy attorney, sent her most of the money needed to replace the funds she used and her other brother sent a smaller amount. She was waiting outside the financial firm's office to put that money into the account after she realized she was in trouble.
This story has the details of how she repaid the funds:

Seems to be alot of corrupt people that have important jobs in this county.Think about it,we have a probate judge convicted going to prison. We have a former county commisioner who is facing charges.Don't forget the police officer trading pills for sex.I seem to remember another police officer that was convicted of a sex crime and is serving time in prison.Oh and to top all of it off,we have a pastor raping kids.

Based on length of phillip's sentence it's very apparent to me she has a better relationship with the higher levels of the Alabama justice system than I do. I'm sure the same will make sure she is assigned to the "office pool" at tutwiler and will not have to degrade herself with the general prison population at any time. After a year or so she will be released on good behavior. Since she is a convicted felon she can't hold public office or be a judge again. What bothers me the most is she will be given a free pass by the Alabama State Bar and be allowed to practice law again. How low of a scumbag do you have to be to not be able to practice law in this state? Yeah sure she will have to waddle over to somewhere in Alabama that no one knows her, but she will still be able to steal .....legally. Well I'm sure the I love sherrie people, the glass houses people and the I love Jesus people are going take a shot at me but I say bring it on. Maybe phillips can be your lawyer in a couple of years....after all she's paid her debt to society, huh.

billybob: I love Jesus and I agree with everything you wrote. I've said before that Jesus only forgives those who repent and ask for forgiveness. The last time I checked, Sherrie had done neither. In my book she's about as low as Obama. She just doesn't have any power.

Here we go....this conversation is bout phillips, but now it's turning to obama.
I for one, hope she serves every day of the three years, and I feel she should serve more. But she won't, so that's that.! AT least we have the satisfaction of knowing she's not running around town for a little while now. I too, wonder just how much money she has "squirreled" away, because we all know this wasn't her first rodeo!
When they told me to write the checks payable to Sherrie, i didn't, I wrote them to the Judge of Probate of Covington County, though I'm sure she comingled those funds with her private ones as well. I wonder how she covered it up for so many years, and why hasn't the DA's office or someone else investigating her found all these things. Did they just stop looking when she was convicted?Makes one wonder.
I sincerely hope she doesn't have cushy office job in teh prison...that's just soooo wrong on sooo many levels! She's a prisoner, an inmate, treat her like one, she's not royalty!

skeptic : THEY ARE BOTH THIEVES so that is the connection and no I won't get over it until he is out of office and neither will any other freedom loving American. Many such as yourself just aren't smart enough to have that figured out yet. George Bush did many things that I disagreed with, but he was not trying to destroy the American peoples freedoms, the way your man is. Your "black" remark is totally racist and I hope every person of any race who reads your ignorant response sees it too. Every freedom loving American of every color will see what a terrible mistake electing Obama was before his first term is over, but they may not have the freedom left to say so.

As you all already know many things have changed in our world over the years and Julia Tutwiler Prison is one of them. It is the 'main' central facility in Alabama for women with the medical facilities, Chapels, and maximum security complete with Death Row.....but it is also a "Processing Station" for new female inmates to sort out and 'classify' as to their security housing classification, Minimum, Medium, or Maximum. It cost the state an enormous amount of money to house 'maximum' security inmates and Julia Tutwiler is a Maximum Security facility, meduim security is a different section all together, or what you would call regular prison like you see on tv.
However, with Sherrie Phillips charge she will be a 'minimum' security risk and will be housed as such, at the lowest cost to the taxpayers of Alabama, many of these inmates work in sewing factories, kitchens, and such around the state and are allowed work release or the Supervised Inmate Release Program. They are not 'special priveleges for 'who you are', they are designed to keep the Prison system from going broke and a 'relief' on you and I, the taxpayer.
Covington County Jail is considered "Maximum Security" behind bars, the State of Alabama reserves that for Death Row Inmates and punishment within the system for infractions commited while inside the system. The State of Alabama is much more professionally run than local county jail. Sherrie Phillips will not get the same treatment from the inmates as the church pastor in the news recently, she will be in a position to 'help' many of them with her knowlege on legal matters and perhaps will be a much busier person inside than she ever was in the 'free world', she is, and still will be, an attorney, whether you have a license or not it dosn't matter in her current situation. I hope she able to 'help someone that really needs it that would not otherwise have a chance in the system.

I'm glad to see there is some juctice but I agree with many that Sherrie will most likely only spend 3 months or stretch it to 6 months then off for good behavior. I wonder how many fights she will get into while in prison because of her mouth. Her mouth can cut better than a knife. If she does go back to being an attorney she will most likely have theives and low lifes as her clients, she has the most personal experience in that. I'm like many of you writers, I would like to see an updated picture of Sherrie in prison now without that "cat ate a mouse" grin. I also would like to know how she was transported? Was she really treated like any other criminal. I doubt it!!!!!

All this talk about making the checks payable to sherrie phillips instead of probate judge got me to thinking of her attempt to deposit $32k cash in the public account along with all her brothers checks to cover her tracks when she found out she had been caught. No one keeps $32k in cash in their house in covington county. Why would you keep that much in cash?....its not traceable thats why. I wonder if the DA followed that money trail when she was charged......just asking. How do you track all those checks into a personal account? Makes you wonder when then county has been running a deficit all these years. I think our current DA should take a looky see and follow the money.

billybob" If I walked into a bank and tried to deposit $32k in cash, it would be time for someone to start asking questions. In her case I'm sure it was easy. She had many taxpayers standing in front of her at the court house writing checks made out to her. That would have been no problem for an honest person. She may have even started off honest, but at some point greed must have taken over and she realized how easy it would be to skim checks and cash undetected. It was dishonest no matter what the reason and you're correct in that she should should be investigated to the max under a separate charge.

Sorry, I don't care if phillip's started off as a honest person or if she is helping the unfortunate people in prison. She is a convicted felon and its not a stretch to think it was her first rodeo that she got caught in. I think asking Greg Gambril's office to audit phillip's last couple years in office if they haven't already. How about it Andy Star News? Any reporters out there want follow up with an interview with Gambril? As a tax payer I would like to know? Anyone else? If she still owes the county see need's to pay up even if it's out of her pension.

Yea, she should be a good "JAILHOUSE" lawyer as they call them,. Reckon, why ole good hubby, "Bud" moved in his trailor on the farm on 55 weeks before she turned herself in? I hope she gets everything that she deserves while she has her short stay there, cause you know she won't be there long.

Sherrie Phillips started working up there in the courthouse back when she was still in high school, I beleive she got out of school at noon during the week on the V.I.E. program and worked for the Honorable Leland G. Enzor and his wonderful wife Bonnie. This was back during just pencil and paper days in the courthouse and a bad copying machine. We had a couple of County Comissioners back then that couldn't read or write, for real. Sherrie wasn't even an attorney when she won the office for herself, although she had worked there 20 years before she ever ran, she went to law school at nights and weekends to graduate the bar after becomming Covington County's Probate Judge.
I realize a lot of people are mad, and hurt with her, maybe its enormous amount of money which is a small 'fortune' to most of us, but she is by far not the most dishonest person in town, we have many theives under many different labels taking our money in Covington County
and giving us the 'short' end of the stick. (This author just got his property tax bill in the mail) same parcel of land for 40 years, but taxes are up 25 times what it used to be.
I think I've looked at some of the same faces in the courthouse I been seeing in some of those offices for most of my life since I've been a grown for over 40 years or else its people that look just like them.

Well! Well! Well! From what all I have seen here today everyone seems upset with the Dishonnorable Sherrie, as all or you know by doing your State Income Taxe return's, on the form there is a question asking for one to report any stolen money or illegal money. Bet she did not report the retirment furnds she taken.
She is not alone here in Covington County, just a few years ago Janice Hart, our tax collecter, had the property on the connor of 55 and 29, to sell for back tax's. At this sale she told us that there was alot of contamanated things there and would cost alot to remove and told everone not to bid on the property and let it go back to the State.
There were two men (both red heads) from Covington County Banck there and when no one made a bid they left, the very next week Johnny McWeed had his crew there cleanning up the place, now there is a church there and a restrant on the conner.
I was told one would have to waite for seven years to have legal rights to the same.
Now is that right? Judge *******, now there is a different story that I would tell but, I know for a fack that he hangs with ex-fleons and I may not be here for long if I tell the story but, he and phillips were best buds.
So stop all the complaints and vote them out.

We all know Sherrie will have it easy and be out way ahead of her time. As for Gambrill investigating further, he probably wouldn't benefit from that venture! I agree, lets vote the "good ole boy" system out of Covington County. I don't think it matters who we make our checks payable to, most of them are crooked anyway. Sherrie will live just fine on all our money she has stashed away and as for her cadillac, she will probably just buy a new one with the interest on her "savings" It is, however, amazing that she got out of county as quickly as she did. They should investigate that place, I'm sure it isn't up to state standards!
