Appellant court upholds local convictions

The Alabama Court of Criminal Appeals affirmed the convictions and sentencing of a father and son in Covington County this week.

The sentences are for Kirk Spenard, 53, and his son, Joseph Spenard, 26.

The pair was both sentenced to 30 years in prison after being convicted in a gun theft.

The Spenards were convicted of theft of property I by a Covington County jury last year.

The evidence at trial showed that Kirk and Joseph Spenard met with the victim under the pretense of buying a pistol. While the victim was showing Kirk the pistol, Joseph grabbed the gun and ran. Kirk blocked the doorway to prevent anyone from pursuing Joseph.

Before leaving, Kirk told the victim, “Let this be a lesson to you. And if we see each other after this, I might give you a head nod, but we don’t know each other.”

After the trial, Circuit Judge Lex Short sentenced Kirk and Joseph Spenard to 30 years imprisonment under the Habitual Felony Offender Act.

District Attorney Walt Merrell, who prosecuted the case, thanked Andalusia Police Department for their solid investigation, which led to the convictions and sentences being upheld on appeal.
