Foster prelim continued

An Andalusia man accused of shooting another man in September will have to wait a bit longer for his day in court.
Shelton L. Foster, 59, is cha-rged with capital murder in the shooting death of Donnie Earl Bone.
A preliminary hearing in the case was set for Wednesday; however, Chief Assistant District Attorney Grace Jeter said both the state and defense counsel – Manish Patel and ChaLea Tisdale – agreed to a continuance to allow for more preparation. Now, in addition to setting a new hearing date, District Judge Trippy McGuire must also appoint a new co-counsel, as Tisdale has accepted a position as assistant district attorney in Baldwin County.
The case began when Bone, 48, was found by a hunter in an area off Old Drag Strip Road, his body hidden under a tarp. Bone had been reported missing by family the day before.
Law enforcement has not released a motive in the case; however, court records show Foster has a criminal history involving prescription pill abuse. He was arrested in January 2010 and indicted by the grand jury on charges of possession of a forged instrument III and two counts of possession of a controlled substance. He has since pleaded guilty to one count of possession of drug paraphernalia. He was given a one-year suspended sentence.
Foster remains in the Covington County Jail without bond.
